Welcome to AllCitations! These Terms of Service ("Terms") govern your access to and use of AllCitations's services, including our website, applications, and citation generation tools (collectively, the "Service"). The Service is provided by AllCitations ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.
You must be at least 13 years old (or the minimum age required in your country to consent to use online services) to use the Service. If you are under 18, you must have your parent or legal guardian's permission to use the Service.
You must provide accurate and complete information to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2.1. Your Responsibilities: You agree to use the Service in compliance with all applicable laws, regulations, and these Terms. You are responsible for your conduct and any content you provide or generate while using the Service.
2.2. Prohibited Uses: You may not use the Service for any illegal, harmful, or abusive activity, or in a way that infringes, misappropriates, or violates anyone's rights. This includes, but is not limited to: engaging in any activity that is unlawful, fraudulent, or deceptive; generating or disseminating content that is hateful, defamatory, obscene, or discriminatory; violating the intellectual property rights of others, including using copyrighted material without permission; attempting to reverse engineer, decompile, or discover the source code or underlying components of our Service; interfering with or disrupting the Service, our servers, or networks; using any automated means (e.g., bots, scrapers) to access or extract data from the Service, except as explicitly permitted by us; or using output from the Service to develop models that compete with AllCitations.
3.1. Your Content: You may provide input to the Service ("Input"), and receive output generated and returned by the Service based on the Input ("Output"). Input and Output are collectively "Content." You are solely responsible for all Content you provide to or generate through the Service, including ensuring that it does not violate any applicable law, these Terms, or the rights of any third party. You represent and warrant that you have all necessary rights, licenses, and permissions to provide Input to our Service and to use the Output as generated.
3.2. Platform Provider: AllCitations is a platform provider. We are not legally responsible or liable for any Content created, generated, or disseminated by users of the Service. This includes, but is not limited to, any illegal inputs or outputs, or any Content that infringes on copyright or other intellectual property rights. You, the user, are fully liable for the Content you create and use in connection with the Service.
3.3. Ownership of Content: As between you and AllCitations, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output. AllCitations hereby assigns to you all its right, title, and interest, if any, in and to Output. Due to the nature of our service, Output may not be unique across users, and other users may receive similar or identical Output. Our assignment above does not extend to the Output of other users.
3.4. Copyrighted Material: You are solely responsible for ensuring that any Input you provide and any Output you generate and use does not infringe upon the copyrights or other intellectual property rights of any third party. AllCitations is not liable for any copyright infringement resulting from your use of the Service or any Content. You agree to indemnify AllCitations against any claims related to copyright infringement arising from your Content.
3.5. Our Use of Content: We may use Content to provide, maintain, develop, and improve our Service, comply with applicable law, enforce our terms and policies, and keep our Service safe. For example, we may use Content to train and improve our citation generation models. If you do not want us to use your Content to train our models, you may be able to opt out by contacting us at contact@allcitations.com. Please note that opting out may limit the ability of our Service to better address your specific use case.
3.6. Accuracy of Output: While we strive to improve our Service, Output may sometimes be inaccurate, incomplete, or may not reflect correct citation formats. Output does not represent AllCitations's views. You understand and agree that: Output may not always be accurate. You should not rely on Output as a sole source of truth or factual information, or as a substitute for professional advice. You must evaluate Output for accuracy and appropriateness for your use case, including using human review as appropriate, before using or sharing Output.
4.1. Our Intellectual Property: The Service, including its underlying technology, software, look and feel, and any content provided by AllCitations (excluding user-generated Content), is owned by or licensed to AllCitations and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purposes, subject to these Terms.
4.2. Feedback: We appreciate feedback, comments, ideas, proposals, and suggestions for improvements. If you provide any of these things, we may use it without restriction or compensation to you.
Certain features of the Service may require payment of fees, such as subscription plans or credits. You agree to pay all applicable fees as described on our pricing page or as otherwise communicated to you.
We use a third-party payment processor (e.g., Stripe) to handle payments. Your payment information is subject to the terms and privacy policies of the payment processor.
Subscriptions may renew automatically unless canceled. You can manage or cancel your subscription through your account settings. Fees are non-refundable except as required by law or as provided in Section 7 (Cancellation & Refunds).
You are free to stop using our Service at any time. We reserve the right to suspend or terminate your access to the Service or delete your account if we determine, in our sole discretion, that: you have breached these Terms or our Usage Policies; we must do so to comply with the law; or your use of the Service could cause risk or harm to AllCitations, our users, or anyone else.
We may also terminate your account if it has been inactive for an extended period (e.g., over one year) and you do not have a paid account. We will provide you with advance notice if we do so.
7.1. Cancel Anytime: You can cancel your subscription at any time via your account settings. If you experience issues cancelling, contact us at contact@allcitations.com.
7.2. Access After Cancellation: When you cancel, your subscription remains active until the end of the current billing period. You will not be charged again unless you restart your subscription.
7.3. Refund Policy: Change of Mind: Once Services have been used (e.g., generating citations, accessing premium features), fees are non-refundable. First-Time Customers: If you are a new customer and cancel within 14 days of your first purchase and you have not used the Services, you are entitled to a full refund. Technical Issues: If a technical issue prevents you from using AllCitations and our support team cannot resolve it within 7 business days of your written notice, you may request a refund for the affected period.
7.4. EU/UK Withdrawal Right: If you are an EU/UK consumer, you may withdraw from your purchase within 14 days of the conclusion of the contract. However, this right ends once you start using the Service (e.g., generating citations), as the Services are digital content delivered immediately upon purchase with your express consent and acknowledgment that you lose the right of withdrawal upon performance beginning.
7.5. Renewals: Subscriptions renew automatically unless cancelled at least 2 business days before the renewal date. Fees for a renewed billing cycle are non-refundable, and you retain access until the end of that cycle.
THE SERVICE IS PROVIDED "AS IS." EXCEPT TO THE EXTENT PROHIBITED BY LAW, ALLCITATIONS AND ITS AFFILIATES AND LICENSORS MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE SERVICE, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE OR ERROR-FREE, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST OR ALTERED. YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUTS FROM OUR SERVICE IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ALLCITATIONS NOR ANY OF ITS AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE OR ONE HUNDRED DOLLARS (US $100). THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
You agree to indemnify and hold harmless AllCitations, its affiliates, and its personnel, from and against any costs, losses, liabilities, and expenses (including attorneys' fees) from third-party claims arising out of or relating to your use of the Service, your Content, or any violation of these Terms.
AllCitations respects the intellectual property rights of others. If you believe that your copyrighted work has been infringed by Content on our Service, please provide us with the following information in writing: a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address; a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
We may delete or disable content that we believe violates these Terms or is alleged to be infringing and will terminate accounts of repeat infringers where appropriate.
These Terms and your use of the Service will be governed by the laws of the Republic of Lithuania, without regard to conflict of laws principles. The courts of Lithuania will have exclusive jurisdiction over any dispute arising from or related to these Terms or the Service, except where mandatory consumer protection law gives you the right to bring claims in your country of residence.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
Entire Agreement: These Terms constitute the entire agreement between you and AllCitations regarding your use of the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely.
